On 12 September 2020, SIDRA held a webinar on mediation in investor-state disputes and were joined by Anna Joubin-Bret, Lucy Reed, Frauke Nitschke, and Zannis Mavrogordato, with Darius Chan and Nadja Alexander moderating. Rebecca Tan has written an article on the webinar which can be accessed through the link below. To quote a small excerpt from the article, the Singapore Convention has already been signed by 53 countries and ratified by six states, which enables the enforcement of international mediated settlement agreements (iMSAs) arrived at by mediation. This ability to enforce iMSAs is likely to make mediation an attractive option, particularly since 90 percent of all bilateral investment treaties include a ‘cooling-off’ period during which arbitration proceedings are required to be put on hold while both parties explore amicable resolutions, including mediation.
